These general conditions of sale (hereinafter “GTC”) apply without restriction or reservation to all sales concluded by the company Pirdy’s (hereinafter “the Company”), with consumers and buyers. non-professionals (hereinafter the “Customer”), wishing to purchase the products offered for sale (hereinafter the “Products”) on the pirdys.com website (hereinafter “the Site”). They specify in particular the conditions of ordering, payment, delivery and management of any returns of the Products ordered by the Customers.
These general conditions may be modified at any time and without notice by Pirdy’s, the modifications then being applicable to all subsequent orders.
Any purchase made or any order placed on the pirdys.com site indicates that the buyer has read and fully and unreservedly accepts the general conditions of sale. Orders placed on the server commit the customer upon receipt of the order and its payment.
All the necessary information and the essential characteristics of the product are presented by the pirdys.com site in each of the product sheets, in accordance with article L.111.1 of the consumer code. The photographs and graphics in the catalog are only indicative and in no way engage the responsibility of the company Pirdy’s. In the event that a supplier slightly modifies a product, the responsibility of the Pirdy’s company cannot be engaged; nor even the validity of the sales contract. In case of unavailability of the product ordered, pirdys.com will offer a replacement product to its customer who will retain full discretion to accept or refuse it.
It is up to the Customer to select the Products he wishes to order on the Site, according to the process in force on the site.
During the first order and/or when registering, the Customer must enter his surname, first name, e-mail address as well as a password which is strictly personal to him, and which will allow him to create a personal account on pirdys .com. The user is responsible for maintaining the confidentiality of his account.
Orders made directly by the buyer on the pirdys.com site only bind the seller when they have been validated, paid and invoiced. After validation of the order, a notice of receipt will be sent by email to the Customer, containing a summary of the information of the order (essential characteristics of the product, price, means of payment, right of withdrawal, delivery times and costs).
For each order, the Customer is required to provide all the information necessary for delivery: complete address, building, access code, floor, telephone number, email, etc.
For orders placed exclusively on the internet, the registration of an order on the site is made when the Customer accepts these GCS by ticking the box provided for this purpose and validates his order. The Customer has the possibility to check the details of his order, its total price and to correct any errors before confirming his acceptance (in accordance with article 1127-2 of the Civil Code). This validation implies acceptance of all of these T&Cs and constitutes proof of the sales contract.
All sales offers are subject to product availability. The particular conditions emanating from the buyer, not accepted in writing by the seller which would be in opposition with the present general conditions or particularities defined in the price offer, will be considered as null. No unilateral cancellation of order will be accepted without the agreement of pirdys.com.
pirdys.com reserves the right to refuse any order from a customer with whom there is a prior dispute as well as any order that does not comply with these T&Cs. In these cases, pirdys.com will contact the Customer by e-mail.

Any complaint, dispute or litigation must be sent in writing to Pirdy’s: info@pirdys.com. In the event of a lack of response within a maximum period of thirty (30) days or in the event of a dispute over its response, the customer may resort to a conventional mediation procedure or to any alternative dispute resolution method, without prejudice to any mandatory legal process.
The delivery is made to the address or place indicated by the buyer during the validation of his order. It is specified that any change of delivery address made by the Customer after the registration of the order may result in an extension of the delivery time. If the package is not collected within the time limit set by the Customer, or if the address provided was incomplete or incorrect, it will be automatically returned to Pirdy’s. This will incur costs which the customer will then have to pay in addition to the shipping costs for a second shipment.
Delivery will be made by La Poste – Colissimo service, with a tracking number which will be communicated to you as soon as your package has left our workshop. The logistics services and carriers do their best to deliver to you as quickly as possible, but packages may experience a delivery delay beyond our control.
Shipping costs for shipments:
– in Metropolitan France: €8
– in Europe: 17€
– for the rest of the world: 28€
The preparation and delivery time for your order is between 2 and 6 weeks. The deadlines announced may be extended without the liability of the company Pirdys being engaged: the delivery time indicated when registering the order is given for information only and is in no way guaranteed. Consequently, any delays in the delivery of the products do not entitle the buyer to cancel the sale, refuse the goods or claim damages. The risk of transport is borne entirely by the buyer.
In the event of a product being out of stock or unavailable, we will inform you by e-mail and we will offer you the following solutions: one or more equivalent products to replace the out-of-stock product; we will tell you the restocking time for your product if it greatly exceeds the time provided for in these GCS; you are also free to cancel the item from your order.
Upon receipt of the Product, the Customer must immediately check, in the presence of the carrier, the condition of the packaging and of the Product delivered. If, at the time of delivery, the packaging is damaged, torn or opened, the Customer must then check the condition of the Products it contains. If these Products have been damaged, the Customer must imperatively refuse the package and note a reservation on the delivery note: damage, missing item, damaged package, broken item. This verification is deemed to have been carried out once the Customer, or a person authorized by him, has signed the delivery note. These reservations must also be confirmed in writing within three working days of delivery, by registered mail AR.
Pirdys.com is released from its delivery obligations for any fortuitous event or force majeure. Force majeure means any external, unforeseeable and irresistible event within the meaning of article 1148 of the Civil Code.
All complaints relating to a defect in the goods delivered, an inaccuracy in the quantities or their erroneous reference in relation to the accepted offer or the confirmation of the order by the seller, must be formulated in writing within 48 hours. upon receipt of the goods, failing which the right to claim will cease to be acquired.
Any return of goods requires the prior written consent of the seller by sending an email to info@pirdys.com. The buyer will receive a return agreement by the means deemed most appropriate by the seller. The buyer has after obtaining the return agreement a period of 14 days to return the goods to the seller. The transport costs due to the return of the material will be borne by the customer if this material does not present a manufacturing defect. It is the same during a product exchange, if it is at the initiative of the customer. ATTENTION: We remind you that returned products and their sales packaging must be in new condition. Nothing should be stuck on the sales packaging of the product or on the product itself. It is possible to reuse the box or the transport bag in which the product was received. All returns must be accompanied by the return form sent by email when validating the return request, to the address of the company Pirdy’s.
The prices displayed on the site are expressed in euros, all taxes included at the French VAT rate. Packaging, order processing and shipping costs are indicated before validation of the order.
Prices are subject to change without notice at any time due to a change in the prices of our suppliers, a change in the VAT rate or for any other reason. The promotional operations carried out by pirdys.com are only valid within the limits of available stocks. The customer agrees to pay the sale price in force at the time of entering his order, and in particular may not take advantage of any subsequent or previous proportional offers.
Payment data is exchanged in encrypted mode using the HTTPS protocol.
Pirdys.com offers several payment methods for your orders:
– by credit card: payment for purchases by credit card is made via the secure platform of our partner Stripe;
– by PayPal;
– payment by bank transfer on request or in the event of a specific and/or exceptional invoice;
– payment in cash at shows, fairs, stands and lodges;
– payment by the pirdys.com gift card, valid for 1 year from the date of issue and non-refundable.
For delivery outside the European Union, the Customer must pay customs duties or other taxes due when the products are imported into the country of the place of delivery. The related formalities are also the sole responsibility of the Client. The Customer is solely responsible for checking the possibilities of importing the Products ordered with regard to the rights of the territory of the country of delivery.
* Late payment :
In the event of total or partial non-payment of the goods delivered on the day of receipt, the buyer must pay pirdys.com a late payment penalty equal to three times the legal interest rate. The rate of legal interest retained is that in force on the day of delivery of the goods. This penalty is calculated on the amount including VAT of the amount remaining due, and runs from the due date of the price without any prior formal notice being necessary. In addition to late payment compensation, any amount, including the deposit, not paid on its due date will automatically result in the payment of a lump sum compensation of 60 euros due for recovery costs. Articles 441-6, I paragraph 12 and D. 441-5 of the Commercial Code.
Pirdys.com retains ownership of the goods sold until full payment of the price, principal and accessories. As such, if the buyer is subject to receivership or judicial liquidation, Pirdy’s reserves the right to claim, within the framework of the collective procedure, the goods sold and remained unpaid.
The legal guarantee of conformity (art. L.217-1 to L217-14 Consumer Code) applies to Products that appear to be defective, damaged or damaged when they are used:
– the legal guarantee against hidden defects (art. 1641 to 1649 of the Civil Code) resulting from a defect in material, design or manufacture affecting the products delivered and rendering them unsuitable for use in the context of normal use. appropriate. It is recalled that under the legal guarantee of conformity, the customer has a period of two years from the delivery of the product to act against the Company, he can choose between repair and replacement. of the product ordered, subject to the cost conditions provided for by article L.217-9 of the Consumer Code and it is exempted from providing proof of the existence of the lack of conformity of the Product during the twenty-four months following delivery of the Product (this period is six months for Products sold second-hand, where applicable). The legal guarantee of conformity applies independently of the commercial guarantee that may possibly cover the Product. The Customer may decide to implement the guarantee against hidden defects of the Product in accordance with article 1641 of the Civil Code; in this case, he can choose between the resolution of the sale or a reduction of the sale price in accordance with 1644 of the Civil Code.
In order to assert his rights, the Customer must inform the Company, in writing, of the non-conformity of the Products or of the existence of hidden defects and return or bring back to the store the defective Products in the state in which they were received with all the elements (accessories, packaging, instructions…).
The guarantee of the products offered on the pirdys.com site is in all cases limited to that of the manufacturers. The warranty can only be activated in the event of a defect occurring during appropriate use of the product and does not cover accidental damage, poor maintenance, damage caused by a third party. The guarantee certificate is constituted by the invoice. For any exchange request, the returned product must imperatively be new, in perfect condition, in its original packaging intact, accompanied by all possible accessories, instructions for use and documentation such as the invoice and/or the right of return.
In accordance with the provisions of Article L.121-16 of the Consumer Code and Articles L 221-18 et seq. of the Consumer Code, the customer may at their discretion waive their order without justifying any reason. To do this, he has the right to withdraw. He can exercise it within 14 days of receipt of the products. Before the expiry of this 14-day period, the customer must inform pirdys.com of his decision to withdraw either by sending him a withdrawal form, or by sending him an e-mail clearly and unambiguously expressing this decision and mentioning the his order to: info@pirdys.com . The customer must return the product, at his own expense (unless the product is not compliant or has a manufacturing defect), to Pirdy’s at the address mentioned on the withdrawal form at the latest within 14 days of the communication of his decision to retract. It is therefore recommended to provide proof of this return, which assumes that the products are returned with parcel tracking, or by any other means giving a certain date. Products returned postage due or cash on delivery will be refused. The risks and perils of the return are fully borne by the customer.
All items subject to a promotional offer will not be taken back or exchanged. The promotional operations carried out by pirdys.com are only valid within the limits of available stocks.
Customizable products are neither exchangeable nor refundable: According to Article L121-20-2 of the Consumer Code: “The right of withdrawal or return cannot be exercised, unless the parties have agreed otherwise, for items designed specially, made to the consumer’s specifications or clearly personalized. This concerns any item that is the subject of a special order and/or manufactured according to specific measurements indicated by the customer. »
Under Law No. 78-17 of January 6, 1978 relating to data processing, files and freedoms, you have a right of access, consultation, modification, rectification and deletion of the data that you have communicated to us.
Disputes arising from the application of these general conditions of sale are subject to French law before the commercial court of Toulon, Var, FRANCE.
